Registration Agreement

RELEASE OF LIABILITY, ASSUMPTION OF RISK AGREEMENT AND

CONCUSSION WAIVER

In consideration for being allowed to attend and/or participate in any way in any program, event or activity of the NTY FC LLC, including but not limited to programs, events or activities related to soccer and gardening.  Participant and, if Participant is a minor (under 18 at the time of registration), Participant's Parent(s)/Legal Guardian(s), acknowledge, appreciate and agree as follows:

  1. The risk of injury from the activities involved in the programs and events of NTY FC LLC is significant; such risk of injury includes, but is not limited to, the potential for permanent very serious circumstances.  

  2. Participant and, if Participant is a minor, Participant's Parent(s)/Legal Guardian(s), acknowledge that Participant is attending and/or participating in such programs, events or activities of NTY FC LLC, and will use and/or be present at 95 County Farm Cross Road facilities or any other location used to conduct NTY FC LLC programs or events, at the Participant’s own risk.

  3. Participant and, if Participant is a minor, Participant's Parent(s)/Legal Guardian(s), KNOWINGLY, FREELY AND VOLUNTARILY ASSUME AND ACCEPT FULL RESPONSIBILITY FOR ALL RISKS, both known and unknown, including but not limited to, the risk to the Participant of personal injury, disability, death and/or property loss, in relation to Participant's attendance and/or participation in the programs, events or activities of NTY FC LLC, use of or presence at 95 County Farm Cross Road facilities, and/or use of or presence at any location used to conduct any program or event of NTY FC LLC, EVEN IF SUCH RISKS ARISE FROM THE NEGLIGENCE OF NTY FC LLC AND/OR ITS OWNERS, OFFICERS, OFFICIALS, EMPLOYEES, AGENTS, INDEPENDENT CONTRACTORS, OTHER PARTICIPANTS, SPONSORS, ADVERTISERS, AND IF APPLICABLE, OWNERS AND LESSORS OF PREMISES USED TO CONDUCT A PROGRAM OR EVENT (collectively referred to as, the "NTY FC RELEASEES") or others.

  4. Participant and, if Participant is a minor, Participant's Parent(s)/Legal Guardian(s) AGREE THAT THE NTY FC LLC RELEASEES SHALL NOT BE LIABLE FOR ANY DAMAGES WHATSOEVER arising from any personal injury, disability, death and/or property loss sustained by Participant and/or his/her family in relation to of Participant's attendance and/or participation in the programs, events or activities of NTY FC LLC use of or presence at 95 County Farm Cross Road facilities, and/or use of or presence at any location used to conduct any program or event of NTY FC LLC EVEN IF SUCH DAMAGES ARISE FROM THE NEGLIGENCE OF THE NTY FC LLC RELEASEES (defined above) or others.

  5. Participant, and if Participant is a minor, Participant's Parent(s)/Legal Guardian(s), for himself/herself/themselves, and on behalf of his/her/their heirs, assigns, personal representatives and next of kin, herby fully and forever RELEASE, DISCHARGE, INDEMNIFY, AND HOLD HARMLESS, THE NTY FC LLC RELEASEES from any and all claims, rights of actions, demands, losses, damages and liability arising out of or related to any INJURY, DISABILITY, DEATH or property loss Participant may suffer in relation to Participant's attendance and/or participation in the programs, events or activities of NTY FC LLC, use of or presence at 95 County Farm Cross Road facilities, and/or use of or presence at any location used to conduct any program or event of NTY FC LLC.

WHETHER ARISING FROM THE NEGLIGENCE OF THE NTY FC LLC RELEASEES OR OTHERWISE.

  1. Participant, and if Participant is a minor, Participant's Parent(s)/Legal Guardian(s), agree that this Release of Liability and Assumption of Risk Agreement ("Release") shall be governed by the laws of the state of New Hampshire. If any provision of this Release shall be found to be invalid or unenforceable, this Release shall be interpreted as if such provision was not a part hereof, but this Release shall otherwise remain in full force and effect.

  2. Participant and, if Participant is a minor, Participant's Parent(s)/Legal Guardian(s), agree that Participant will follow the rules of conduct and play set by NTY FC LLC. Failure to do so may result in suspension from participation.

  3. Participant, and if Participant is a minor, Participant's Parent(s)/Legal Guardian(s), agree that by checking the box below, he/she/they are effectively signing this Release and agreeing to be bound by its terms. BY CHECKING THIS BOX, I/WE, BEING THE PARTICIPANT, AND IF THE PARTICIPANT IS A MINOR, THE PARTICIPANT'S PARENT(S)/LEGAL GUARDIAN(S), CERTIFY THAT I/WE HAVE READ THE ABOVE RELEASE, ACKNOWLEDGE THAT IT IS A RELEASE OF LIABILITY, FULLY UNDERSTAND AND AGREE TO ITS TERMS, AND UNDERSTAND THAT I/WE HAVE GIVEN UP SUBSTANTIAL RIGHTS BY ENTERING INTO THIS RELEASE; I/WE CHECK THIS BOX AND AGREE TO BE BOUND BY THE TERMS OF THIS RELEASE FREELY, VOLUNTARILY AND WITHOUT ANY INDUCEMENT. 

WAIVER/RELEASE/ASSUMPTION OF RISK FOR COMMUNICABLE DISEASES, INCLUDING COVID-19


In consideration of being allowed to participate in programs, related events, or activities offered by NTY FC LLC, including the right to

access public fields, the undersigned acknowledges, appreciates, understands, and agrees that: 

1. Participation includes possible exposure to, and illness from, infectious diseases including but not limited to MRSA, influenza,

and COVID-19 (collectively “Infectious Diseases”). While particular rules and personal discipline may reduce this risk, the risk

of serious illness and death does exist; 

2. NTY FC LLC cannot prevent you or your child(ren) from becoming exposed to, contracting, or spreading Infectious Diseases

while participating in NTY FC LLC programs or accessing its premises or fields. It is not possible to prevent against the

presence of Infectious Diseases. Therefore, if you choose to utilize services or enter into NTY FC LLC premises or fields, you

may be exposing yourself to Infectious Diseases and or increasing your risk of contracting or spreading Infectious Diseases; 

3. I willingly agree to comply with the stated and customary terms and conditions for participation as regards protection against

Infectious Diseases. If, however, I observe any unusual or significant hazard during my presence or participation, I will remove

myself from participation, and bring such to the attention of the nearest NTY FC LLC official immediately; 

4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, HOLD

HARMLESS, AND AGREE TO INDEMNIFY NTY FC LLC, their officers, directors, officials, agents, employees, other

participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct

the programs (“RELEASEES”), WITH RESPECT TO ANY AND ALL ILLNESS, DISABILITY, DEATH, or loss or damage to

person or property, WHETHER ARISING FROM THE NEGLIGENCE OF RELEASEES OR OTHERWISE, to the fullest extent

permitted by law; 

5. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS PERTAINING TO INFECTIOUS DISEASES, both known and

unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for

my participation; and 

I HAVE READ THIS WAIVER/RELEASE/ASSUMPTION OF RISK FOR COMMUNICABLE DISEASES INCLUDING COVID-19,

FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN

IF FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION)

This is to certify that I, as parent/guardian, with legal responsibility for this participant, have read and explained the provisions in this

waiver/release to my child/ward including the risks of presence and participation and his/her personal responsibilities for adhering to

the rules and regulations for protection against communicable diseases. Furthermore, my child/ward understands and accepts these

risks and responsibilities. I for myself, my spouse, and child/ward do consent and agree to his/her release provided above for all the

Releasees and myself, my spouse, and child/ward do release and agree to indemnify and hold harmless the Releasees for any and all

liabilities incident to my minor child’s/ward’s presence or participation in these activities as provided above, EVEN IF ARISING FROM

THEIR NEGLIGENCE, to the fullest extent provided by law.

I/We, as the Participant's Parent(s)/Legal Guardian(s), do hereby grant authority to the staff at NTY FC LLC to render a judgment concerning medical assistance or hospital care in the event of an accident or illness related to the Participant during my/our absence. I/We do hereby authorize NTY FC LLC and its assigns to utilize any and all photographs, pictures or other likeness of myself/us, the Participant or anyone assigned guardianship to me/us, as they deem appropriate in its promotional materials or team films.

  2. I/We, as the Participant's Parent(s)/Legal Guardian(s), agree that by checking the box below, I/we are effectively signing this Consent and agreeing to be bound by its terms.

HEADS UP Concussion Waiver 

This sheet has information to help protect your children or teens from concussion or other serious brain injury. Use this 

information at your children’s or teens’ games and practices to learn how to spot a concussion and what to do if a concussion 

occurs. 


What Is a Concussion? 

A concussion is a type of traumatic brain injury—or TBI—caused by a bump, blow, or jolt to the head or by a hit to the body that causes the head and brain to move quickly back and forth. This fast movement can cause the brain to bounce around or 

twist in the skull, creating chemical changes in the brain and sometimes stretching and damaging the brain cells. 


How Can I Help Keep My Children or Teens Safe? 

Sports are a great way for children and teens to stay healthy and can help them do well in school. To help lower your children or teens’ chances of getting a concussion or other serious brain injury, you should: 

  • Help create a culture of safety for the team.  

  • Work with their coach to teach ways to lower the chances of getting a concussion. 

  • Talk with your children or teens about concussion and ask if they have concerns about reporting a concussion. Talk with them about their concerns; emphasize the importance of reporting concussions and taking time to recover from one. 

  • Ensure that they follow their coach’s rules for safety and the rules of the sport. 

  • Tell your children or teens that you expect them to always practice good sportsmanship. 

  • When appropriate for the sport or activity, teach your children or teens that they must wear a helmet to lower the chances of the most serious types of brain or head injury. However, there is no “concussion-proof” helmet. So, even with a helmet, it is important for children and teens to avoid hits to the head. 


How Can I or the Coach Spot a Possible Concussion? 

Children and teens who show or report one or more of the signs and symptoms listed below—or simply say they just “don’t 

feel right” after a bump, blow, or jolt to the head or body—may have a concussion or other serious brain injury. 

Signs Observed by Parents or Coaches:

  • Appears dazed or stunned. 

  • Forgets an instruction, is confused about an assignment or position, or is unsure of the game, score, or opponent. 

  • Moves clumsily. 

  • Answers questions slowly. 

  • Loses consciousness (even briefly). 

  • Shows mood, behavior, or personality changes. 

  • Can’t recall events prior to or after a hit or fall. 


Symptoms Reported by Children and Teens

  • Headache or “pressure” in head. 

  • Nausea or vomiting. 

  • Balance problems or dizziness, or double or blurry vision.  

  • Bothered by light or noise. 

  • Feeling sluggish, hazy, foggy, or groggy. 

  • Confusion, or concentration or memory problems. 

  • Just not “feeling right,” or “feeling down.” 

Talk with your children and teens about concussion. Tell them to report their concussion symptoms to you and their coach 

right away. Some children and teens think concussions aren’t serious or worry that if they report a concussion they will lose 

their position on the team or look weak. Be sure to remind them that it’s better to miss one game than the whole season. 

Concussions affect each child and teen differently. While most children and teens with a concussion feel better within a 

couple of weeks, some will have symptoms for months or longer. Talk with your children or teens’ health care provider if 

their concussion symptoms do not go away or if they get worse after they return to their regular activities. 


What Are Some More Serious Danger Signs to Look Out For

In rare cases, a dangerous collection of blood (hematoma) may form on the brain after a bump, blow, or jolt to the head or 

body and can squeeze the brain against the skull. Call 9-1-1 or take your child or teen to the emergency department right 

away if, after a bump, blow, or jolt to the head or body, he or she has one or more of these danger signs: 

  • One pupil is larger than the other. 

  • Drowsiness or inability to wake up. 

  • A headache that gets worse and does not go away. 

  • Slurred speech, weakness, numbness, or decreased coordination. 

  • Repeated vomiting or nausea, convulsions or seizures (shaking or twitching). 

  • Unusual behavior, increased confusion, restlessness, or agitation. 

  • Loss of consciousness (passed out/knocked out). Even a brief loss of consciousness should be taken seriously. 

Children and teens who continue to play while having concussion symptoms or who return to play too soon—while the brain 

is still healing— have a greater chance of getting another concussion. A repeat concussion that occurs while the brain is still 

healing from the first injury can be very serious and can affect a child or teen for a lifetime. It can even be fatal. 


Action Plan for Coaches: 

  1. Remove the Athlete from Play: Take the athlete out of the game or practice immediately if you observe any signs or symptoms of a concussion. Remember, “When in doubt, sit it out!”

  2. Seek Medical Attention: Do not try to assess the severity of the injury yourself. Instead, ensure that the athlete is evaluated by a healthcare professional experienced in evaluating concussions.

  3. Inform and Educate Parents: Notify the athlete’s parents or guardians about the known or possible concussion. Provide them with information about the situation and give them a copy of the concussion action plan. 

  4. Allow Athlete to return to play only with permission from an appropriate health care professional. Any athlete who sustains a concussion must “receive a medical release from a licensed health care professional.”
